1. General Overview
These Terms and Conditions apply to all tutoring services provided by Developing Genius Tutoring (“we”, “our”, “us”) to clients in South Australia and across Australia. By booking any session, the client (“you”, “your”) agrees to these terms.
2. Bookings and Payment
All tutoring sessions must be booked in advance via our website, phone, or email. Payment must be made no later than 24 hours prior to the session via approved methods (e.g., bank transfer, Stripe, or card). Fees are in Australian Dollars (AUD) and include GST (if applicable).
3. Cancellations and Refunds
You may cancel or reschedule a session with at least 24 hours’ notice. Less than 24 hours’ notice will incur the full session fee. Refunds or credits will not be provided for no-shows. Under Australian Consumer Law, you are entitled to a refund if we cancel or fail to provide a service with due care and skill.
4. Late Arrival
Sessions start and end on time. If the student is late, the session will still finish at the scheduled time. If a student does not arrive within 15 minutes without contact, the session will be considered cancelled without refund.
5. Student Progress
While we strive to support academic improvement, we do not guarantee specific grades or outcomes. Success depends on the student’s effort, participation, and ongoing practice beyond sessions.
6. Online Tutoring
It is your responsibility to ensure the student has a stable internet connection, working microphone/webcam, and quiet learning space. Sessions may be recorded for internal training purposes, only with your written consent.
7. Child Protection and Working with Children
All tutors hold current Working With Children Checks (WWCCs) as required under South Australian law. Students under 16 must have a parent/guardian present or nearby during online sessions. We comply with the Child Safety (Prohibited Persons) Act 2016 (SA) and mandatory reporting obligations.
8. Learning Materials and Intellectual Property
All resources, worksheets, and lesson content created by us remain our intellectual property. You may use resources for personal use only and may not distribute or reproduce them for others.
9. Communication and Feedback
We may provide progress updates to parents/guardians upon request or after major assessments. Communication between tutor and parent should remain respectful, focused on the student’s development.
10. Amendments
We may update these Terms and Conditions at any time. The latest version will be available on our website and applies from the date of publication.
